第一章 总 则
第一条 为全面加强劳动合同管理,维护社会主义市场经济条件下的劳动秩序,促进劳动关系的和谐发展,根据《中华人民共和国劳动法》(以下简称《劳动法》)及有关法律、法规和规章,结合我市实际,制定本办法。
第二条 本市行政区域内的各类企业、个体经济组织(以下统称用人单位)和与之形成劳动关系的劳动者,适用本办法。
国家机关、事业单位、社会团体和与之建立劳动合同关系的劳动者,依照本办法执行。
第三条 用人单位与劳动者订立劳动合同,必须贯彻平等自愿、协商一致的原则,任何一方不得把自己的意志强加给对方,任何单位和个人不得非法干预。
第四条 有下列情形之一的,属无效劳动合同:
(一)违反法律、法规和规章订立的劳动合同;
(二)采取欺诈、威胁和隐满事实等手段订立的劳动合同;
(三)劳动权利义务不对等,严重损害一方当事人合法权益订立的劳动合同;
(四)未经当事人委托,由一方当事人或第三人代签订立的劳动合同。
(五)损害国家、社会公共利益和第三者利益订立的劳动合同。
第五条 市劳动保障行政部门主管全市劳动合同管理工作,各县、区人民政府劳动保障行政部门负责所辖区域内劳动合同管理工作。
第六条 各级经贸、公安、工商行政管理、乡镇企业管理、工商联、私协、个协等部门和组织应采取积极有效措施,支持和配合劳动保障部门做好对用人单位的劳动合同管理工作。
第二章 劳动合同签订、鉴证和履行
第七条 用人单位招用劳动者,应到当地劳动保障行政部门办理录用备案手续;与劳动者建立劳动关系,必须按照《劳动法》第十六条、第十九条规定,以书面形式订立劳动合同,明确双方权利和义务。
第八条 用人单位与劳动者依照《劳动法》第二十条规定,经协商一致,可以订立有固定期限、无固定期限和以完成一定工作任务为期限的劳动合同。对劳动者在同一用人单位连续工作满10年以上,当事人双方同意续签劳动合同的,如果劳动者提出订立无固定期限的劳动合同,用人单位应当与其订立无固定期限的劳动合同。
第九条 用人单位签订劳动合同的对象为:企业全体职工,国家机关、事业单位、社会团体和与之建立劳动合同关系的劳动者。
第十条 各类企业的厂长、经理和党组织主要负责人,应与其任命、聘任部门签订劳动合同。实行公司制企业的厂长、经理,应按照《中华人民共和国公司法》规定与董事会签订劳动合同。
第十一条 用人单位与劳动者可依照《劳动法》第二十一条规定,在劳动合同中约定试用期,试用期最长不得超过六个月。试用期包含在劳动合同期限内,从劳动合同生效时间算起。劳动合同期限在六个月以下的,试用期不得超过15日;劳动合同期限在六个月以上一年以下的,试用期不得超过30日;劳动合同期限在一年以上两年以下的,试用期不得超过60日;二年以上的,试用期不得超过六个月。用人单位与劳动者续订劳动合同,对改变工种的,应当在劳动合同中重新规定试用期,不改变工种的,不再规定试用期。
第十二条 劳动合同生效时间,一般应从双方当事人在劳动合同上签字之日起计算;如果双方当事人在劳动合同中规定了生效日期,则从规定的生效日期起计算。
劳动合同期限最后一天的截止时间,应以劳动合同期限最后一天的24时为准。
第十三条 下列情况,用人单位与劳动者必须在30日内签订劳动合同,并办理鉴证手续:
(一)用人单位与新招用人员,自确定录用之日起;
(二)用人单位与新调入职工,自职工报到之日起;
(三)用人单位与国家政策性安置的复员退伍军人、军队转业干部、大中专和技工学校毕业生,自报到之日起。
第十四条 用人单位招用职工时应查验其终止、解除劳动合同证明,以及其他能证明该职工与任何用人单位不存在劳动关系的凭证,方可与其签订劳动合同。
第十五条 劳动合同鉴证必须遵循“依法鉴证、保证质量、体现服务”的原则。劳动合同由用人单位所在地的劳动保障行政部门的劳动仲裁机构(以下简称仲裁机构)鉴证。劳动合同鉴证应审查下列内容:
(一)当事人双方是否具备签订劳动合同的主体资格;
(二)劳动合同内容是否符合国家劳动法律、法规和政策;
(三)当事人双方是否在平等自愿和协商一致的基础上签订劳动合同;
(四)劳动合同条款是否完备,双方的权利和义务是否明确;
(五)中外文劳动合同文本是否一致。
第十六条 申请劳动合同鉴证时,劳动合同双方当事人应提交下列材料:
(一)签订的劳动合同文本和企业申请劳动合同鉴证职工花名册二份;
(二)用人单位为法人的,应提供其法定代表人身份证明或授权委托书;用人单位不是法人的,应提供其主要负责人的身份证明或授权委托书和国家工商行政管理部门颁发的营业执照;
(三)劳动者身份证明;
(四)仲裁机构认为需要的其他材料。
第十七条 对审查合格的劳动合同,仲裁机构应予鉴证。对当事人提供的劳动合同文本及证明材料不完备,应通知当事人予以补正。对不真实、不合法的劳动合同,不予鉴证,并向当事人说明理由,在合同文本上注明。对审查不合格的劳动合同,应指导当事人按照要求修改和重新签订,然后办理鉴证手续。
第十八条 仲裁机构对劳动合同予以鉴证后,如发现有误应立即撤销并退还鉴证费,或重新鉴证。
第十九条 对已鉴证的劳动合同,与其依据的政策法规重新调整后有矛盾时,可重新办理鉴证手续,但不再收取鉴证费。
第二十条 劳动合同鉴证为有偿服务,劳动合同当事人应按照国家和省有关规定向仲裁机构缴纳鉴证费,鉴证费由双方当事人分担。
第二十一条 劳动合同依法订立即具有法律约束力,当事人双方必须严格履行劳动合同规定的义务。
第三章 劳动合同的变更、解除、终止及续订
第二十二条 有下列情形之一的,经当事人双方协商一致,可以变更劳动合同的相关内容:
(一)用人单位转产或调整生产任务的;
(二)订立劳动合同时所依据的客观情况发生重大变化,致使原劳动合同无法履行的;
(三)由于不可抗力致使劳动合同无法继续履行的;
(四)变更劳动合同,应从一方当事人提出变更劳动合同之日起30日内,签订变更劳动合同协议,并注明生效日期。变更劳动合同协议经仲裁机构鉴证后,与原劳动合同具有同等效力。变更劳动合同也不再收取鉴证费。
第二十三条 根据《劳动法》第二十四条规定,经当事人双方协商一致,劳动合同可以解除。
第二十四条 用人单位解除劳动合同,必须严格按照《劳动法》第二十五条、第二十六条、第二十七条规定执行。
第二十五条 劳动者有《劳动法》第二十九条规定情形之一的,用人单位不得解除劳动合同。
第二十六条 用人单位解除劳动合 同,工会认为不适当的,有权提出意见。如果用人单位违反法律、法规或劳动合同,工会有权要求重新处理;劳动者申请仲裁或提起诉讼的,工会应给予支持和帮助。
第二十七条 劳动者解除劳动合同,必须严格按照《劳动法》第三十一条、第三十二条规定执行。
第二十八条 有下列情形之一的,劳动合同应当终止:
(一)劳动合同期满或者当事人约定的劳动合同终止条件出现的;
(二)劳动关系主体一方消亡的;
(三)仲裁裁决或人民法院判决不予履行的;
(四)法律、法规规定应当终止的。
第二十九条 劳动合同期限届满,因用人单位生产、经营(工作)需要,经双方当事人协商同意,可以续订劳动合同。
第四章 劳动合同解除、终止、续订的办理程序
第三十条 用人单位根据《劳动法》第二十五条规定,与劳动者解除劳动合同的,应自决定解除劳动合同之日起0日内下达《解除劳动合同通知书》。
第三十一条 用人单位根据《劳动法》第二十四条、第二十六条、第二十七条解除劳动合同的,应提前30日开具《解除劳动合同通知书》。
第三十二条 劳动合同期满,用人单位不愿与劳动者续订劳动合同,应提前30日开具《终止劳动合同通知书》;用人单位确定与劳动者续订劳动合同的,应提前30日开具《续订劳动合同征求意见书》,征求劳动者意见。10日内劳动者未做出答复的,按终止劳动合同办理;劳动者愿意续订的,用人单位应于劳动合同期满前10日内办理续订手续。
第三十三条 用人单位与劳动者解除、终止劳动合同应办理有关手续,并为劳动者开具《解除(终止)劳动合同证明书》,注明解除、终止劳动合同原因,并报所在地劳动保障行政部门的劳动仲裁机构备案。
上述通知书、意见书和证明书送达劳动者时,用人单位与劳动者应履行送达手续。劳动者收到用人单位解除或终止劳动合同的书面决定和证明书后,应在30日内持单位发给的有关证明材料和身份证到劳动保障机构申请办理失业登记手续,按规定享受失业保险。
第五章 用人单位劳动合同管理
第三十四条 用人单位应建立健全内部规章制度,把日常工作考核、工资管理、工时休假、保险福利、职工奖惩、劳动纪律等规章制度 与劳动合同履行密切衔接起来,更好地发挥劳动合同管理作用。
第三十五条 用人单位应设立《劳动合同订立情况台帐》,记录劳动者自进入企业后劳动合同的订立、变更、续订、终止、解除过程的基本情况。
第三十六条 用人单位在填写台帐时,应按合同到期年度将签订不同期限劳动合同的劳动者分序造册,详细反映本单位劳动合同期限构成情况,以便根据劳动者劳动合同到期数量、 性别、年龄结构,做好续订或终止劳动合同的工作。
第三十七条 用人单位要为劳动者建立《劳动合同卡》,详细记录劳动者劳动合同订立、变更、续订、解除、终止等情况。本卡每位劳动者一份,由用人单位的劳动合同管理部门负责填写并统一保管。劳动者与用人单位解除(终止)劳动合同后,本卡随劳动者本人档案一并转移。
第六章 违反劳动合同的责任和劳动争议处理
第三十八条 当事人一方或双方违反劳动合同,给对方造成损害的,根据其后果和责任大小,依法承担赔偿责任。
第三十九条 用人单位故意拖延不与劳动者订立劳动合同或未按劳动合同规定的条件擅自解除劳动合同,以及违反劳动合同规定,侵害劳动者合法权益的,依照《劳动法》第九十八条和劳动部颁布的《违反〈中华人民共和国劳动 法〉行政处罚办法》、《违反〈劳动法〉有关劳动合同规定的赔偿办法》的有关规定,承担相应行政责任、民事责任。
第四十条 用人单位招用尚未解除劳动合同的劳动者,对原用人单位造成经济损失的,应当依法承担连带赔偿责任。
第四十一条 因履行、变更、解除和续订劳动合同发生的争议,当事人双方应当及时协商解决。协商不成时,当事人可以向本单位劳动争议调解委员会申请调解;调解不成,当事人一方要求仲裁的,可以向当地劳动争议仲裁委员会申请仲裁。当事人一方也可以直接向劳动争议仲裁委员会申请仲裁。对仲裁裁决不服的,可以向人民法院提起诉讼。
第七章 附 则
第四十二条 本办法由市劳动和社会保障局负责解释。
第四十三条 本办法自2002年5月20日起施行。
